Information on the processing of personal Data

This page describes the characteristics of the processing of personal data of users (the "Users") of the website https://taskom.at (the " Website"), according to Article 13 of Regulation (EU) 679/2016 ("GDPR").

 


 

1. Data controller and the Data controller’s contact information

The data controller is the Taskomat Srl, a company active in digital innovation through the creation of a web-based management platform for self-employed workers. 2. Method for collecting data and the type of data processed.

2.1. Browsing Data automatically collected by the Website: login and browsing data

Whenever Users access the Website, the computer systems and software procedures used to operate the Website, during their operations, collect the following Data

access and browsing (for example, IP addresses or domain names of the computers used by the Users, the URI - Uniform Resource Identifier - addresses of the resources requested, the time of the request, the method used to submit the request to the server, the size of the file obtained in response, the numerical code indicating the status of the response given by the server and other parameters relating to the User's operating system and computer environment - the "Browsing Data").



2.2. Data disclosed by the Users: personal data for the creation of the Taskomat Account

Certain areas of the Website require Users, subject to acceptance of the Conditions of Use, to disclose specific personal data: name, surname, e-mail (the "Account Data"). This Data is required, in particular, for the registration of an account that enables access to a reserved area, thanks to which it is possible to use the relative services for the use of the Taskomat web-based application (the "Taskomat Services").

According to Article 14 of the GDPR, we also inform you that the Account Data may also be provided via Facebook® or Google+®; in this case, the party that will provide the Data to us will be, depending on the case (i) the US company Facebook Inc., the personal data processing information of which is given here; or the US company Google Inc., the personal data processing information of which is provided here

The provision of Account Data (independently, through Facebook® or Google®) is voluntary: if Users do not provide it, they can still browse the Website without benefiting from that area's features. Also, Account Data is collected if, to the extent and in the manner in which it is disclosed by the Users.

The Users are invited not to disclose personal data of third parties unless it is necessary (for example, because the User who wants to access the reserved area does not have his/her e-mail address and does not have any other direct contact details): in this case, we remind you that it is up to the User to fulfil the legal obligations regarding the protection of personal data and, in particular, to inform the third parties of the disclosure and, if necessary, to obtain consent.

 

2.3. Data disclosed by the Users: e-mail for receiving the Newsletter

By accessing the Taskomat blog, the Users have the opportunity to provide Taskomat with their e-mail by filling in a special form to subscribe to the newsletter service (Newsletter Data), aimed at allowing the User to benefit from this service and, therefore, to receive via e-mail updates on the tech and digital world, freelancing, customer and project management, as well as on Taskomat's activities.

The disclosure of Newsletter Data is mandatory: any refusal will make it impossible for Taskomat to send the Newsletter to the User. (Browsing Data, Account Data, and Newsletter Data, collectively, the "Data.")


 

2.4. Cookies

3. Purpose and legal basis of the processing

The Browser Data will not be used: (i) to monitor the proper functioning of the Website, (ii) on an anonymous and aggregated basis, for statistical purposes related to understanding how the Website is used by Users, to improve accessibility and increase attractiveness, and (iii) to detect technical problems as soon as possible.

Such processing finds its legal basis in the Company's legitimate interest in improving its products and digital services. It is compatible with the position of the data subjects since (a) the monitoring of the functioning of the Website and the statistical data related to its use does not involve direct identification; and (b) the interest of the Company reasonably appears to be also that of the Users, who will thus be able to benefit from an increasingly performing and optimized Website.

The Account Data will be used to allow the creation of a User account, which provides access to a reserved area through which the User can use the Taskomat Services. The legal basis for this processing is the need to execute a contract to which the User is a party (i.e. the Conditions of Use).

It is hereby specified that the e-mail, which is part of the Account Data, will also be used to send information exclusively on the progress and operative functions of the Taskomat Services.

This processing has its legal basis in the legitimate interest of the Company in transparent information with Users with a view to the best possible contractual performance, and is compatible with the data subject's position, in that: (A) the notification is aimed exclusively at informing the User who uses the Taskomat Services of the updates and improvements of the same; and (b) the Company's interest reasonably appears to be also that of the Users, who will, therefore, always be able to know the features of the Taskomat Services.

The Newsletter Data will be used to send the User updated e-mails on the world of tech and digital, freelancing, customer and project management, and the Taskomat's activities. This processing has its legal basis in the need to execute a specific request of the User.



 

4. Recipients of the Data

The Data will be disclosed and may be known (i) by employees and collaborators of the Company, duly instructed on the processing; and (ii) by third parties who provide services ancillary or instrumental to the activities of the Company, in relation to the development, delivery and operational management of the Website and the reserved area, specifically appointed as data processors.


 

5. Place of processing and transfer of Data abroad

The User’s Data will be processed at the Company's registered office mentioned and above and stored on the services located within the European Union.

Any further transfer of Data abroad will take place if to countries that do not benefit from an adequacy decision of the European Commission and that, therefore, do not offer an adequate level of protection to personal data, only (i) after adopting appropriate safeguards such as, by way of example, the signing of the standard clauses approved by the European Commission or (ii) when there is an exception to the prohibition of transfers outside the European Union and, therefore, again by way of example, after obtaining the express and informed consent of the User, or only to the extent that is necessary for the performance of a contract concluded between the User and the Company, or between the Company and a third party for the benefit of the User, or the performance of pre-contractual measures adopted at the User's request.

 

6. Processing methods, safety measures and data retention period

The Data will be processed both in paper form and with electronic, computerized or automated instruments through systems that ensure data protection, security and confidentiality.

Moreover, the Company has adopted specific and adequate logical, legal, organizational and technical security measures to prevent the loss of Data, unlawful or unauthorized use of the same and unauthorized access.

Browsing Data - which do not allow the identification of Users - do not persist for more than 7 days and are deleted immediately after their aggregation (except for the possible need to ascertain crimes by the competent Judicial Authority).

Account Data, aimed at responding to the User's request to access the reserved area and use the Taskomat Services, will be kept for the entire contractual relationship duration and for the time prescribed by the applicable regulations.

Newsletter Data will be stored and processed up to 12 months from registration. With one month's notice, Taskomat will ask the User if he/she wishes to continue receiving the Newsletter: in case of refusal, the Newsletter Data will be erased; in case of consent, they will be stored and processed for a further 12 months.

The Data will be kept for more extended periods where this is necessary to fulfil statutory and/or legal obligations and ensure the judicial protection of the Company's rights in compliance with the ordinary statute of limitations.



 

7. User's rights

Users, as data subjects (i.e., subjects to whom the Data refer), are holders of rights conferred by the GDPR. In particular, according to Articles 12-23 of the GDPR, Data Subjects have the right to request and obtain, at any time, access to their personal data, information on the processing performed, rectification and/or updating of personal data, cancellation and restriction of the processing. They also have the right to object to the processing and request data portability (i.e., to receive personal data in a commonly used, structured format that automatic devices can read). Finally, data subjects always have the right to revoke their consent at any time (this, in any case, will not affect the lawfulness of the processing carried out based on the consent given before the revocation) and to lodge a complaint with a supervisory authority (in Italy: the Garante per la Protezione dei Dati Personali)
